A theory can be an explanation of a piece of the world. A theory of law is intended to be an explanation of that phenomenon of social communication which we call Law. But, Raffaele De Giorgi, perhaps the person responsible for the introduction of luhmannian theory in Argentina, (jointly with Torres Nafarrate in Mexico in translating Luhmann’s work to Spanish), asked: What is a theory of society? What is the “Law of society”? And answered: Can we discuss this?, (...) hands managed by hands, nothing different from a prostheses. According to De Giorgi we are sure that the themes that we use as objects or objects that we use as themes, are our construction, we think that we turn around ourselves, while we continue rotating around the vacuum. It is a paradox, or another paradox: ¿Is it possible to get out or get rid of these paradoxes? Logic does not help us. Logic, according to Luhmann, can only see to the fact that some expressions, with unavailable truths, are in contradiction with other expressions, the problem cannot be resolved us- ing logical operations. With the help of Gegenparadoxierungen (against-par- adox), systemic therapy is the alternative where the problem can be toler- ated. And, according to Luhmann, the placement of the paradox should be conducted in a more or less skilled, successful, or useful way to break the logjam.A creative use of paradoxes, especially legal ones, allows us to observe how Luhmann’s theory has impacted existing theories in ArgentinaThemes such as the paradoxality of law, or its being without foundation (and without beginning, the vacuity of their principles and the opacity of its distinctions and operations), filtered theories (like Carlos Cárcova or Ernesto Grün) and jurisprudential practices have started shifting things to what Bielefeld Professor has called “old European”Resumen:Una teoría puede ser una explicación de un sector del mundo. Y recordó que, en cierto sentido, la colocación de la paradoja se realizará con más o menos éxito, esto es: de manera útil para desbloquear la situación.Y es el uso creativo de paradojas, especialmente uno que se hizo por el Derecho, el que nos permite observar cómo su teoría (la de Luhmann) se ha comenzado a reciclar en las teorías existentes en Argentina. Temas como el problema de la paradojalidad del Derecho, de su ser sin fundamentos y sin comienzo, de la vacuidad de sus principios y la opacidad de sus operaciones y distinciones, se filtran teorías (como las de Carlos Cárcova o Ernesto Grün) y prácticas de la jurisprudencia y puede verse que ha comenzado a remover ese tipo de pensamiento que el profesor de Bielefeld había llamado “vétero europeo”. Riassunto: Presentiamo una prospettiva semiotica e dinamica per indagare e discutere dal punto di vista psicologico i fenomeni della regolazione affettiva attraverso la mediazione e l’articolazione dei segni. Al fine di evitare uno sguardo semplicistico, lineare e riduttivo, i fenomeni affettivi sono presentati come campi quasi strutturati, i quali vengono a differenziarsi attraverso mediatori semiotici. La loro funzione è quella di orientare le persone attraverso l’anticipazione dell’immediato futuro. La regolazione semiotica conduce alla costruzione di gerarchie – temporanee – ovvero strutture (...) di segni che incanalano le esperienze. Dalla costituzione di segni operatori di meta-livello segue sia la veloce espansione della costruzione di segni sia l’arresto e la demolizione della temporanea gerarchia regolativa di segni. Tali segni permettono tanto l’espansione flessibile quanto la limitazione della profondità e della ridondanza dei processi di auto-regolazione delle esperienze soggettive e delle azioni nei diversi contesti. Parole chiave: Mediazione semiotica; Segni; Gerarchie; Affetti; Regolazione affettiva; Campi affettivi The Dynamic Regulation of Affective Processes through Semiotic Mediation: We introduce a semiotic and dynamic perspective to investigate and discuss – from a psychological point of view – the process of affective regulation through the mediation and articulation of signs. In order to avoid a simplistic, linear and reductive appraisal, affective phenomena are presented as quasi-structured fields, which differentiate themselves through semiotic mediators. Their function is to orient people in anticipation of the immediate future. Semiotic regulation leads to the construction of temporary hierarchies, namely structures of signs that guide experiences. From the constitution of meta-level operator signs ensues both the rapid expansion of the construction of signs and the arrest and the demolition of the temporary regulatory hierarchy of signs. These signs allow for flexible expansion but also limit the “depth” and redundancy of self-regulation processes in subjective experiences and actions in different contexts. Background and aims. In pediatrics receiving a diagnosis of a chronic condition is a matter that involves caregivers at first. Beyond the basic issues of caring for the physical body of the ill child, caregivers’ manners of facing and making sense of the disease orient and co-construct their children’s sensemaking processes of the disease itself. The aim of this article is to explore the experience of a rare chronic illness, Hereditary Angioedema (HAE), in pediatrics, from the caregivers’ perspective. Hereditary Angioedema (...) is characterized by subcutaneous swellings that can involve the mucosal tissues of external as well as internal parts of the body, manifesting in a highly variable and unpredictable way in terms of localization, severity, and frequency. Materials and methods. Within a qualitatively-driven research design, we conducted a qualitative narrative semiotic analysis of n.28 mothers’ narratives on their children’s disease experience. Narratives were collected by an ad hoc interview on three domains of the disease experience: A. interpretation of the disease variability; B. dialogical processes; C. management of the disease. Subsequently, we executed a TwoStep cluster analysis for categorical data to detect cross-sectional profiles of the maternal sensemaking processes of the disease. Results. The coding grid was built analyzing the characteristic of the narrative links that orient the connection between the elements of the experience within each domain: A. the connection among events, for the domain of the interpretation of the disease variability; B. the connection between self and other, for the domain of the dialogue; C. the connection among sensemaking and actions, for the domain of the management of the disease. Results from cluster analysis show three narrative profiles: 1. adempitive; 2. reactive; 3. dynamic. Discussion. Profiles will be discussed in the light of the general conceptual framework of the Sense of Grip on the Disease (SoGoD) highlighting the importance of those sensemaking processes which, instead of relying on a coherent and close interpretation of the disease, are characterized by a degree of tolerance for the uncertainty and the unknowingly. Fondamentali risultano i linguaggi con i quali trovano espressione le contestazioni dell'ordine, in particolare il linguaggio giuridico che è spesso usato sia per contestare l'ordine sia per confermarlo. Las reflexiones que volcó en sus libros, y que expuso en foros de discusión que recorrieron el mundo, estuvieron siempre empeñadas en desentrañar el sentido de nuestra historia, con el fin de esclarecer y organizar los saberes y las prácticas de nuestra vida espiritual. (...) Ello, sin perder de vista la necesidad de buscar todos aquellos modos que permitan articular nuestra cultura y nuestra historia con la cultura y la historia universales. The reflections in his books, also presented at discussion forums all over the world, always tried to disclose the meaning of our history in order to enlighten and to organize the knowledge and the practices of our spiritual life, this being so without neglecting our concern about the way our history and culture articulate with the universal history and culture. Moreover, his work nourishes a tradition always aimed at strengthening the ideals of freedom, people's autonomy, and integration, and especially the capacity to "imagine future societies just as desirable for all", as don Leopoldo would say. The theoretical dialogue that has been going on for many years between the philosophies of the modern period and the social sciences on the institutional structuring of the social body and the political body can shed light on the concept of ‘esprit de corps’. The purpose is to address the issue raised by social science researchers concerning this concept and to use it as an indication of a broader work spanning corpora and periods from early modernity onwards. Therefore, this article (...) proposes to examine Malebranche’s texts to explore the ‘esprit de corps’, understood as the awareness of being part of a whole, and the moral injunctions that this sense of belonging entails. Like other philosophers of his time, Malebranche reflected on the notion of ‘political bodies’ and on how people belong to the various bodies they form. In pursuing this archaeology of a concept that emerged late in the ‘Ancien Régime’, we also appropriate the theoretical tools proposed by Michel Foucault in some of his works on power over bodies. Malebranche's ideas about the imagination have inspired philosophers over the centuries. Drawing on the writings of Aristotle, Bacon, Descartes and many other sources, Malebranche created his own innovative theory. It is especially his work on the force of the imagination, however, that was to be of lasting influence. In this introductory article, we briefly discuss Malebranche's theory of the imagination and point out its role in mathematics, contagion of ideas, monstrous births, errors of the mind and rhetoric.

In this article I examine the notion of human dignity as it appears to ground fundamental human rights, both in the Universal Declaration of 1948 and in the Swiss Federal Constitution. I claim that it is hard to find good arguments in favour of the idea that human dignity should be understood as the intrinsic value of human beings qua human beings. Dignity in this sense is traditionally identified as something a human being cannot lose. I argue that this criterion (...) should be put aside and that we should rather talk of active and passive attributions of dignity. I claim that the latter type of attribution appeals to the idea of standards of life which each specific type of creature should fulfil in order for its life to be considered as a dignified life for that type of creature. Next, I argue that the notion of well-being grounds the normativity of passive attributions of dignity and address a few objections against this view. Finally, I show how this view accommodates the idea expressed in the Swiss Federal Constitution, that creatures other than human beings can have dignity. (shrink)

El contexto rural colombiano, en los años noventa, se configuró, a partir de un discurso de desarrollo que desconoció y estigmatizó a la población campesina. En este sentido, “el trabajador agrario”, tal y como lo considera la Constitución Política de 1991, no refiere a la realidad específica de las comunidades campesinas, sino a un “pequeño productor”, que como lo indica el Informe de Desarrollo Humano de 2011, representa a individuo con un rol secundario, que con asistencia crediticia y técnica puede (...) ponerse a nivel, pero solo como productor de mediana escala. El presente artículo de reflexión tiene por objetivo analizar los efectos biopolíticos que ha tenido la visión política del desarrollo implementada en el campo colombiano, en esta época, haciendo énfasis en la forma como se han establecido las necesidades para esta población. This book presents a historical and scientific analysis as historical epistemology of the science of weights and mechanics in the sixteenth century, particularly as developed by Tartaglia in his Quesiti et inventioni diverse, Book VII and Book VIII (1546; 1554). -/- In the early 16th century mechanics was concerned mainly with what is now called statics and was referred to as the Scientia de ponderibus, generally pursued by two very different approaches. The first was usually referred to as Aristotelian, where (...) the equilibrium of bodies was set as a balance of opposite tendencies to motion. The second, usually referred to as Archimedean, identified statics with centrobarica, the theory of centres of gravity based on symmetry considerations. In between the two traditions the Italian scholar Niccolò Fontana, better known as Tartaglia (1500?–1557), wrote the treatise Quesiti et inventioni diverse (1546). -/- This volume consists of three main parts. In the first, a historical excursus regarding Tartaglia’s lifetime, his scientific production and the Scientia de ponderibus in the Arabic-Islamic culture, and from the Middle Ages to the Renaissance, is presented. Secondly, all the propositions of Books VII and VIII, by relating them with the Problemata mechanica by the Aristotelian school and Iordani opvsculvm de ponderositate by Jordanus de Nemore are examined within the history and historical epistemology of science. The last part is relative to the original texts and critical transcriptions into Italian and Latin and an English translation. -/- This work gathers and re-evaluates the current thinking on this subject. In this paper, we deal with Torricelli’s principle in mechanics according to which two heavy bodies linked together cannot move by themselves unless their common centre of gravity descends. At the beginning of the De motu gravium naturaliter descendentium, in his Opera geometrica (1644), Evangelista Torricelli (1608–1647) expressed this principle in a very brief section entitled Praemittamus. Our aim is to sustain the idea that Torricelli was constructing a general view of a kind of physics based on general principles, of (...) which the previous one is the most important and explicit statement. In our discussion, the following themes are addressed: (1) a comparison between the Torricelli’s principle and the virtual work principle; (2) the role of Torricelli principle within the history of the virtual work principle; (3) the logic behind the demonstrations offered in physics relying on general principles such as that of Torricelli. This book offers insights relevant to modern history and epistemology of physics, mathematics and, indeed, to all the sciences and engineering disciplines emerging of 19th century. This research volume is the first of a set of three Springer books on Lazare Nicolas Marguérite Carnot’s (1753–1823) remarkable work: Essay on Machines in General (Essai sur les machines en général [1783] 1786). The other two forthcoming volumes are: Principes fondamentaux de l’équilibre et du mouvement (1803) and Géométrie de position (1803). Lazare Carnot (...) – l'organisateur de la victoire – in Essai sur le machine en général (1786) assumed that the generalization of machines was a necessity for society and its economic development. Subsequently, his new coming science applied to machines attracted considerable interest for technician, as well, already in the 1780’s. With no lack in rigour, Carnot used geometric and trigonometric rather than algebraic arguments, and usually went on to explain in words what the formulae contained. His main physical– mathematical concepts were the Geometric motion and Moment of activity–concept of Work . In particular, he found the invariants of the transmission of motion (by stating the principle of the moment of the quantity of motion) and theorized the condition of the maximum efficiency of mechanical machines (i.e., principle of continuity in the transmission of power). While the core theme remains the theories and historical studies of the text, the book contains an extensive Introduction and an accurate critical English Translation – including the parallel text edition and substantive critical/explicative notes – of Essai sur les machines en général (1786). The authors offer much-needed insight into the relation between mechanics, mathematics and engineering from a conceptual, empirical and methodological, and universalis point of view. We make several remarks concerning properties of functions in parabolic De Giorgi classes of order p. There are new perspectives including a novel mechanism of propagating positivity in measure, the reservation of membership under convex composition, and a logarithmic type estimate. Based on them, we are able to give new proofs of known properties. In particular, we prove local boundedness and local Hölder continuity of these functions via Moser’s ideas, thus avoiding De Giorgi’s heavy machinery. We also seize (...) this opportunity to give a transparent proof of a weak Harnack inequality for nonnegative members of some super-class of De Giorgi, without any covering argument. (shrink)

Este artigo analisa a origem e os objetivos políticos da celebração do Dia Internacional da Mulher a partir do estudo das socialistas norte-americanas e alemãs enquadradas na Internacional Socialista de Mulheres. O trabalho enfoca as discussões sobre a "questão feminina" e a luta pelo sufrágio universal feminino nos partidos socialistas da Alemanha e dos Estados Unidos; em particular na relação política que os socialistas tiveram que manter com os movimentos feministas burgueses. Procuraremos demonstrar que o Dia Internacional da Mulher foi (...) uma iniciativa da Internacional Socialista da Mulher no âmbito da luta pelo sufrágio universal feminino e pela obtenção de melhores condições de trabalho e de vida para as mulheres trabalhadoras. A celebração desta data articulava-se como instância de agitação e propaganda de um trabalho político de longa data que as mulheres socialistas desenvolviam entre as trabalhadoras desde finais do século XIX no quadro da Segunda Internacional. Un tema transversal que aparece en la obra de la filósofa Judith Butler, especialmente en Vida precaria y Marcos de guerra, tiene que ver con la experiencia afectiva que tienen los sujetos. Por esta razón, el objetivo del presente artículo teórico es analizar la manera como la filósofa norteamericana trata el tema de los afectos o las emociones. El texto se centra en demostrar la pertinencia de la reflexión en torno a los afectos, ya que es un elemento crítico-social que (...) ayuda a comprender la constitución de la subjetividad y la agencia, tanto individual como colectiva; asimismo, pretende ofrecer nuevos aportes para el entendimiento de las situaciones contemporáneas de discriminación y opresión, pero también de resistencia en contextos democráticos. Aun cuando el sujeto, desde sus experiencias afectivas, se encuentra condicionado por los marcos normativos sociales, es posible pensar en luchas desde el afecto, como una salida ante los efectos restrictivos que este genera.
